Family disputes go well beyond divorce. We advise on the custody and welfare of children, guardianship of a child and a child's property, adoption, and the rights of elderly parents to maintenance.
The welfare of the child is the court's paramount concern in custody and guardianship cases, and many family matters can be settled through mediation at the Family Court.
Under Sections 24 and 25 of the Hindu Marriage Act, either spouse can claim maintenance from the other, depending on their income and circumstances. Maintenance under Section 144 BNSS, however, can be claimed by a wife, children and parents.
