Matrimonial Cases

Maintenance, domestic violence, dowry and cruelty cases, and restitution of conjugal rights — for wives and husbands.

Family & Matrimonial · Lucknow

Matrimonial disputes often run in several courts at once — a maintenance case, a domestic violence complaint, a criminal case for cruelty or dowry, and a divorce petition. We coordinate all of them so that each supports your overall position.

We act for both wives and husbands. Remedies include protection, residence and monetary orders under the Protection of Women from Domestic Violence Act, 2005; maintenance under Section 144 BNSS and the Hindu Marriage Act; return of stridhan; restitution of conjugal rights; and judicial separation.

When you may need this

  • You need maintenance for yourself or your children
  • You are facing domestic violence
  • A dowry or cruelty case has been filed against you or your family
  • Your jewellery and belongings (stridhan) have not been returned
  • Your spouse has left and you want to save the marriage

How we handle it

  1. We understand all pending and likely cases
  2. We decide the right forum and sequence
  3. We seek interim maintenance or protection orders
  4. We represent you through evidence and arguments
  5. We pursue a global settlement where possible

Documents to bring

  • Marriage certificate and photographs
  • Income proof of both spouses
  • Medical records and complaints, if any
  • List of stridhan and gifts
  • Copies of all notices and cases

Questions about Matrimonial Cases

Can a husband also claim maintenance?

Under Sections 24 and 25 of the Hindu Marriage Act, either spouse can claim maintenance from the other, depending on their income and circumstances. Maintenance under Section 144 BNSS, however, can be claimed by a wife, children and parents.
