Family & Matrimonial

Divorce, maintenance, custody, domestic violence, wills and succession — handled with discretion.

Practice group · Lucknow

Family matters need legal skill and sensitivity in equal measure. We advise husbands, wives, parents and families on divorce, maintenance, custody, domestic violence, and on wills and inheritance.

Wherever it serves the family better, we work towards a mediated settlement rather than a long contest in court.

Common questions

How long does a mutual consent divorce take in India?

Ordinarily at least six months from the first motion, since the second motion is moved after six months. The court can waive this period in suitable cases, and the second motion must be moved within 18 months of the first.

Do we need to live in separate houses for one year?

Not necessarily. The requirement is that the spouses have not been living together as husband and wife for at least one year before filing.

Can a husband also claim maintenance?

Under Sections 24 and 25 of the Hindu Marriage Act, either spouse can claim maintenance from the other, depending on their income and circumstances. Maintenance under Section 144 BNSS, however, can be claimed by a wife, children and parents.

Is it compulsory to register a will?

No. A will is valid if it is signed and attested by two witnesses. Registration is optional, but a registered will is much harder to challenge and is advisable.
