Partition Suits

Division of jointly owned or inherited property among family members and co-owners.

Civil & Money Recovery · Lucknow

When co-owners or heirs cannot agree on dividing property, any of them can ask the court to partition it. The court first decides who has what share (a preliminary decree), and then how the property will be physically divided or sold (a final decree), often through a court commissioner.

For agricultural land in Uttar Pradesh, partition is usually sought before the revenue court under the UP Revenue Code, 2006. Since 2005, daughters have equal rights with sons in Hindu joint family property. See also our Property Disputes page.
