Learn more →Summary suits and regular suits to recover loans, dues and unpaid amounts.
If someone owes you money on a loan, invoice, cheque or written agreement, a suit can be filed to recover it with interest. A summary suit under Order XXXVII of the Code of Civil Procedure is faster where the claim is based on a written contract, a cheque or other negotiable instrument; the defendant can only defend with the court's permission.
Claims generally must be filed within three years. Where the amount is over ₹3 lakh and commercial in nature, the suit goes to the Commercial Court. If a cheque was involved, a criminal complaint under Section 138 may also be available.
