Victims of road accidents, and the families of those who die in them, can claim compensation before the Motor Accident Claims Tribunal under the Motor Vehicles Act, 1988. Compensation takes into account loss of income, medical expenses, pain and suffering and loss of dependency, and is usually paid by the insurer of the vehicle at fault.
Claims should be filed promptly after the accident. For hit-and-run accidents, a separate government compensation scheme applies.
Usually the insurance company of the vehicle at fault, if it was insured. The owner and driver of the vehicle can also be held liable. The claim is decided by the Motor Accident Claims Tribunal.
