Quick answer: If a retired Uttar Pradesh government employee's pension, gratuity, leave encashment or other retiral dues are held up, the first step is a written representation with documents to the Head of Office and the pension-sanctioning authority, plus an RTI application to find out where the file is stuck. If the dues are still not paid, a writ petition under Article 226 of the Constitution can be filed in the Allahabad High Court (at the Lucknow Bench for the Awadh districts), asking for payment within a fixed time with interest for unjustified delay. Pension can be withheld or reduced only in the situations, and by the procedure, set out in Article 351-A of the Civil Service Regulations.

Which retiral dues does a retired UP government employee get?

Depending on the date of joining and the scheme that applies, the dues usually include:

  • Pension (or family pension after death) and commutation of part of it
  • Retirement or death gratuity under the UP Retirement Benefits Rules, 1961 and the Civil Service Regulations
  • Leave encashment, GPF final payment and the group insurance amount
  • For employees under the National Pension System, the NPS corpus and annuity instead of the old pension

The Payment of Gratuity Act, 1972 generally does not apply: its definition of "employee" in Section 2(e) leaves out persons holding a post under a State Government who are covered by other gratuity rules.

Delays usually come from an incomplete service book, pending no-dues certificates, an audit objection, a proposed recovery, or a pending inquiry.

Can the government withhold pension or gratuity?

Courts have long treated pension as a right earned by service, not a bounty. Under Article 351-A of the Civil Service Regulations (as applicable in Uttar Pradesh), the Governor may withhold or withdraw a pension, wholly or partly, or order recovery of a loss from it, only if the pensioner is found in departmental or judicial proceedings to have been guilty of grave misconduct, or to have caused pecuniary loss to the Government by misconduct or negligence during service.

If departmental proceedings were not started while the employee was in service:

  1. they cannot be started without the Governor's sanction;
  2. they can relate only to an event that took place not more than four years before the proceedings start; and
  3. they must follow the procedure applicable to proceedings for dismissal from service.

The UP Public Service Commission must be consulted before the final order. So pension cannot simply be stopped because of a complaint, an audit note or a "recovery" written in the file, without proceedings that meet these conditions.

What happens if an inquiry or case is pending?

  • Provisional pension: Under Article 351-AA read with Article 919-A of the Civil Service Regulations, a retired employee facing pending proceedings is paid a provisional pension, equal to the maximum pension admissible on the qualifying service, until final orders are passed.
  • Gratuity: Article 919-A(3) allows the death-cum-retirement gratuity to be held back until the proceedings end and final orders are passed.
  • Other dues: GPF is the employee's own savings, and its final payment follows the GPF rules, not Article 351-A.

What should I do first?

  1. Check the case status on the Finance Department's UP e-Pension portal (where the Pension Payment Order can also be downloaded), or ask the Head of Office in writing.
  2. Send a written representation to the Head of Office, with copies to the Head of Department, the pension-sanctioning authority and the Pension Directorate or treasury. Attach the retirement order, service book extracts, last pay certificate, no-dues certificates and earlier letters.
  3. Ask for specific action: sanction of pension and gratuity, issue of the PPO, release of leave encashment, GPF and group insurance, and interest for the delay.
  4. File an RTI application under Section 6 of the Right to Information Act, 2005 for the file notings and the reason for the delay. The reply is ordinarily due within 30 days (Section 7). If there is no reply, a first appeal lies under Section 19.
  5. Keep proof of every letter. It shows the court that the department was approached first.

When can I file a writ petition in the High Court?

If the representation brings no result within a reasonable time, a writ petition under Article 226 can be filed in the Allahabad High Court. Matters arising in the Awadh districts (such as Lucknow, Barabanki, Rae Bareli, Sitapur, Hardoi, Unnao and Ayodhya) are filed at the Lucknow Bench; others at Prayagraj.

The petition commonly asks the court to:

  • direct the authorities to sanction the pension and release the dues within a fixed time;
  • quash an order withholding pension or gratuity, or ordering recovery, passed without following Article 351-A;
  • award interest on the delayed amounts.

A widow or other family member can follow the same route for family pension.

Can I go to the UP Public Services Tribunal instead?

UP state government employees can also take service disputes, including pension claims, to the UP Public Services Tribunal, Lucknow, under the Uttar Pradesh Public Services (Tribunal) Act, 1976. Under Section 5(1)(b) of that Act, a claim must ordinarily be filed within one year, and the time taken by a representation or departmental appeal is excluded. The High Court may sometimes ask a petitioner to go there first. Central government employees go to the Central Administrative Tribunal instead.

Will I get interest on delayed pension or gratuity?

Government orders in Uttar Pradesh have provided for interest on gratuity paid late for reasons not attributable to the employee, and courts have generally taken the view that a retiree kept out of his dues without justification should get interest. Ask for it specifically in the representation and the petition.

Is there a time limit?

A writ petition has no fixed limitation period, but the High Court looks at delay. Non-payment of pension is generally treated as a continuing wrong, yet very old arrears may be restricted. Act within months, not years.

Frequently asked questions

My pension has not started after retirement. What should I do first?

Check the status on the UP e-Pension portal, send a written representation with documents to the Head of Office and the pension-sanctioning authority, and file an RTI application to find out where the file is pending.

Can my gratuity be held back because an inquiry is pending?

Yes, Article 919-A(3) of the Civil Service Regulations allows gratuity to be held back until the proceedings end. A provisional pension must still be paid meanwhile, and proceedings started after retirement must meet the conditions of Article 351-A.

Can money be recovered from my pension without an inquiry?

No. Under Article 351-A, recovery of a loss from pension needs a finding in departmental or judicial proceedings. A recovery order passed without that procedure can be challenged.

Can a departmental inquiry be started after I retire?

Only with the Governor's sanction, and only about an event that took place not more than four years before the proceedings are started. The UP Public Service Commission must be consulted before the final order.

Does the Payment of Gratuity Act apply to UP government employees?

Generally not. Section 2(e) of the Payment of Gratuity Act, 1972 excludes persons holding a post under a State Government who are governed by other gratuity rules, so the state's own rules apply.

Which court should a retired UP government employee approach?

The Allahabad High Court under Article 226, at the Lucknow Bench for the Awadh districts, or the UP Public Services Tribunal, Lucknow, within the one-year period under Section 5(1)(b) of its Act.
