A property purchase is only as safe as the seller's title. A few weeks of checks before payment can prevent years of litigation afterwards. This checklist covers the main steps for property in Lucknow and elsewhere in Uttar Pradesh.
Check the title
- Obtain copies of the chain of title documents — sale deeds, gift deeds, wills, partition deeds — going back as far as possible (commonly 30 years).
- Confirm the seller is the lawful owner and, for inherited property, that all legal heirs have consented.
- For leasehold property from a development authority, check the lease terms and whether it has been converted to freehold.
- Verify the identity of the seller against the documents.
Revenue records
- Check the khatauni (record of rights) on the UP Bhulekh portal for agricultural or rural land.
- Confirm that mutation (dakhil kharij) has been done in the seller's name.
- Check that property tax and utility bills are paid up to date.
Encumbrances and loans
- Search the registration records for mortgages or other transactions over the property (the IGRSUP portal allows online searches).
- If the property is mortgaged, get a no-dues certificate from the lender and ensure the loan is closed before or at the time of sale.
- Check for pending litigation involving the property or the seller.
Approvals and RERA
- Confirm the building plan is sanctioned by the Lucknow Development Authority (or relevant authority) and the construction matches it.
- For flats, check the completion or occupancy certificate.
- For new projects, confirm registration with UP RERA and review the project details there.
- Check the land use permits residential construction.
Payment and registration
- Make payments through banking channels and record them in the agreement.
- Pay stamp duty and registration fee at the current rates (check IGRSUP for the latest rates and any concessions).
- Register the sale deed at the Sub-Registrar's office with both parties and witnesses present.
After purchase
- Apply for mutation in your name.
- Transfer electricity, water and property tax records.
- Keep the original documents safely and store scanned copies.
